We keep your personal information for only as long as necessary to fulfill the purpose for which it was collected and to meet our legal and contractual obligations. The length of time we retain personal information varies, depending on the purpose for which it was collected and the nature of the personal information. Packetlabs Ltd. is based in Canada, with additional offices in the United States, and Packetlabs Pty Ltd. based in Australia. Depending on your location and which Packetlabs entity you interact with, your personal information may be transferred to, stored, and processed in a country other than the one in which you are located, including Canada, the United States, Australia, and Germany, where privacy laws may offer different levels of protection than those in your home jurisdiction. We do not sell personal information for monetary payment. However, our use of advertising and analytics service providers, including Google Analytics, Google Ads, LinkedIn, and Microsoft/Bing, to serve interest-based advertising and evaluate our marketing performance may constitute a “sale” or “share” of personal information under the CCPA, because these providers may receive identifiers or internet activity information about you for cross-context behavioral advertising purposes. If the CCPA applies to our processing of your personal information, you have the right to:

Other State Privacy Laws
Residents of certain other U.S. states with comprehensive privacy laws in effect may have similar rights to know, access, delete, and correct their personal information, and to opt out of targeted advertising, the sale of personal information, and, in some states, profiling in furtherance of decisions that produce legal or similarly significant effects.
This section supplements the rest of this Privacy Policy and applies specifically to individuals in Australia. In Australia, personal information is collected and handled by Packetlabs Pty Ltd. (ABN 14 691 178 542) in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (“APPs”).

We collect, hold, use, and disclose personal information about you for the purposes described in the “Personal Information” and “Use of Your Personal Information” sections above, including to assess and provide penetration testing and related cybersecurity services, and for direct marketing purposes as described below. We only collect sensitive information (as defined under the Privacy Act) with your consent or as otherwise permitted by law.
Automated decision making
We use personal information in the operation of computer programs to make, or do something directly related to making, a decision that could significantly affect the rights or interests of an individual. The types of personal information we use in the operation of these kinds of computer programs include HubSpot and Gong.
The kinds of decisions we make solely by the operation of such computer programs include hiring and information storage.
Direct Marketing
Where we send you direct marketing communications, you may opt out of receiving further such communications at any time using the unsubscribe mechanism included in those communications or by contacting us at privacy@packetlabs.net, consistent with Australian Privacy Principle 7.
Overseas Disclosure
As described in the “Cross-Border Transfer and Storage of Personal Information” section above, we may disclose your personal information to related entities and service providers located outside Australia, including in Canada, the United States, and Germany. Before doing so, we take reasonable steps to ensure that these overseas recipients handle your personal information in a manner consistent with the APPs, including through contractual arrangements, except where an exception under APP 8.2 applies.

If we experience a data breach involving your personal information that is likely to result in serious harm, we will notify you and the Office of the Australian Information Commissioner (“OAIC”), where required, in accordance with the Notifiable Data Breaches scheme under the Privacy Act.
